MINUTES OF THE Continuing BNA BOARD AND TREE COMM. MEETING
October 24, 2007, North Harbour Mews Recreation Building, 7Pm
The joint meeting of the Board of Directors and the Tree Committee was called to
order at 7:00 pm at the North Harbour Mews recreation center.
Board Members present were: Matt Whitney, Stan Hart, Walter Valenta, Leslie Sawyer, CherryAnn Kolbenschlag,
Chuck Wilson, Jon Peterson and Kim Swenson. Stan Hart resigned and Chuck Wilson stepped in to act as Treasurer for the
Neighborhood. Sam is on vacation so Becky Whitney has agreed to take the minutes.
Members of the Tree Committee present were Elise and Stuart Goforth, Tom Kelly
and Becky Whitney.
The PDC Parks Bond Measure was discussed, people are writing grants for us.
Walter and Matt talked at length about the issue.
The Bridgeton tree issue was the #1 topic. Elise reported that Dave McAllister, the Urban Forester, called her and said
that he did not agree with the drainage district that the tree cutting was an
emergency issue. “Let’s compromise” is what McAllister suggested – much discussion ensued about actions – what should we do now?
Walter talked about which trees were going to be cut – he had additional information on what was going on. Elise and all talked at length about Drainage District, its organization, board
make up and upcoming election. Much discussion was had about the Penn2 Board and Dave Hendricks, who’s in charge and who apparently has not kept the drainage district board
informed. Discussion of which trees were regulated by the City Forester.
Elise reported on the City tree cutting permit rules and which city regs were
backing the rules.
Penn2 Board elections – Walter should run. We need a representative for the December annual meeting. Talk ensued about the votes each Bridgeton HOA carried plus other groups, golf
club and PYC.
Continuing with old business, we discussed bills and financial issues. A promissory note idea was proposed to the board to allow payment to Scott. All was approved – Sam was the only member absent so the motion passed.
Cherry Ann gave her ideas on a concert issue. Problem with Pier 99 – no heat and electrical problems. Decided to put concern off until February. Discussion was had about options and timing.

Fundraising effort needs to be escalated. We don’t know how much our final bill will be.

MINUTES OF THE SPECIAL BOARD AND TREE COMMITTEE MEETING
September 19, 2007, Mews Recreation Building, 7Pm
The special joint meeting of the Board of Directors and the Tree Committee was
called to order at 7:00 pm at the North Harbour Mews rec center. Board Members present were: Matt Whitney, Stan Hart, Jon Peterson, Walter Valenta, Leslie Sawyer, CherryAnn
Kolbenschlag. Tree Comm. members present were: Tom Kelly, Alice and Stuart
Goforth, Karen Trusty, Carol Emory and Becky Whitney. Others attending: Wayne
Low and Dr. Don Gray. Brent Foster Exec. Director of Columbia Riverkepers and
Scott Jerger of the Fields Jerger firm attended by conference call.
1. The special meeting was called to discuss the issue of the Penn 2 Drainage
District tree removal project and the Boards approval of obtaining a temporary
restraining order to prevent the district from cutting additional trees in the
neighborhood. Earlier in the day, Matt Whitney, Chair authorized Scott Jerger of the Fields
Jerger law firm to obtain the order from the Multnomah County Circuit Court. The BNA Board vote was unanimous. Alice Goforth reported that earlier that afternoon once the attorneys had
obtained the temporary restraining order from the court and it was faxed and
hand delivered to the Penn2 office she and Karen Trusty approached Dave
Hendricks who was supervising the cutting of 12 birch trees at the Portland
Yacht Club and notified him of the restraining order. Despite the notification
of the judges order Dave refused to stop the cutting and the last birch tree
was cut down at approximately 4 PM.
2. The legal points of the restraining order were reviewed. BNA is arguing that the actions of the drainage district would cause irrevocable
damage to the structural integrity of the levee. Dr. Donald Gray the author of the USACE study of vegetation of levees provided
an overview of the science backing our actions and the analysis he had done on
the Bridgeton levee and the affidavit he has prepared indicating that the
drainage district’s action are damaging to the structural integrity of the levee. Carol Emory reviewed the ORS statute that requires Penn2 to have a licensed
chief civil engineer on staff, the requirement for prompt and thorough
notification of land owners and a 14 day appeal process, the lack of a city
tree cutting permit, and the lack of a reclamation plan and mitigation plan as
required by city code section 547and others, all of which Penn2 has ignored.
3. Plans were made to encourage neighborhood involvement in a show cause hearing
in Multnomah County court for next Friday. Legal process was discussed involving period of 10 days the petition of review
requesting a Writ then requesting a stay of the order.
4. The Board in an Executive Session approved legal retainer expenditures.
5. Tom Kelly reported on the support BNA was obtaining from Congressman Earl
Blumenauer’s office and especially the support from Mary Gautreaux of Senator Ron Wyden’s office. Letters of support have been received from City Commissioners Leonard, Saltzman,
and Mayor Potter and County Commissioner Cogen.
6. USACE contacts were discussed; Procedure/strategy of continuing USACE
contacts was also discussed. Sacramento situation and contacts reviewed.
7. Dr Gray reported on the survey he had completed earlier in the week with the
civil engineers of the Geo Design team we had hired. Full reports of both Dr. Gary and the Geo Design team were made available to the
BNA Board.
8. Fund raising issue was discussed. The neighborhood will be approached and
asked to contribute. Volunteers sought and volunteer coordinator to be
appointed.
9. BNA Board voted unanimously to continue to retain council for the Writ
procedure in conjunction with the Columbia Riverkeepers attorney Brent Foster
and continued consultation with attorney Karl Anuta.
The Special BNA Board meeting was adjourned at 9:30 PM.
